This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit www.sharktalk.ai, create or use a SharkTalk account, request information or a demonstration, schedule a call, communicate with our representatives, receive text messages from us, call a telephone number operated by a SharkTalk AI voice agent, or otherwise interact with SharkTalk.
By using our website or services, or by voluntarily providing information to us, you acknowledge that you have reviewed this Privacy Policy. If you do not agree with this Privacy Policy, please do not submit personal information to us or use our services.
1. Scope of this Privacy Policy
This Privacy Policy applies to information collected through:
- Our website at www.sharktalk.ai and any subdomains;
- The SharkTalk platform, dashboard, and application (the "Platform");
- Emails sent to or received from info@sharktalk.ai or other SharkTalk addresses;
- Telephone calls, demonstrations, and consultations with our team;
- SMS and MMS communications sent by SharkTalk;
- Contact, demo-request, and call-back forms on our website;
- Telephone calls handled by AI voice agents deployed through the Platform (see Section 5);
- Customer support and service communications;
- Contracts, proposals, invoices, and payment-related interactions;
- Social media pages or other online channels operated by SharkTalk; and
- Other direct interactions with SharkTalk.
This Privacy Policy does not apply to websites, applications, or services owned or controlled by third parties, including the businesses and agencies that use the Platform to deploy their own AI voice agents ("Business Customers").
2. Our Two Roles: Controller and Processor
SharkTalk handles personal information in two distinct capacities:
(a) As a business ("controller") - when we collect information from website visitors, prospective customers, account holders, and the users that Business Customers invite to the Platform. This Privacy Policy governs that information.
(b) As a service provider ("processor") - when AI voice agents deployed by a Business Customer answer or place calls with that Business Customer's own callers, leads, patients, or customers ("End Callers"). In that case, the Business Customer determines why and how End Caller information is collected, and its own privacy policy governs. SharkTalk processes End Caller information only on the Business Customer's documented instructions and under our agreement with that Business Customer.
If you are an End Caller and have questions about how your call was handled, please contact the business you called. We will also assist Business Customers in responding to End Caller requests.
3. Information We May Collect
3.1 Contact and Account Information
- First and last name;
- Email address;
- Telephone or mobile number;
- Company or organization name, industry, and website;
- Job title or role;
- Mailing or business address;
- Account credentials (passwords are stored in hashed form);
- Role and permission settings within the Platform; and
- Other contact information that you voluntarily provide.
3.2 Inquiry, Demo, and Consultation Information
- The nature of your inquiry;
- Information about your business, call volume, and current phone setup;
- Services, integrations, or features in which you are interested;
- Preferred contact method, date, or time;
- Communications exchanged with our representatives; and
- Any other information you choose to provide.
3.3 Platform Configuration Information
When you configure AI voice agents, we collect the information you enter, including agent names, voices, greetings, instructions, business hours, service areas, FAQs, transfer destinations, telephone numbers, and integration credentials or authorization tokens for third-party systems you choose to connect (for example, a CRM or calendar).
3.4 Communications Information
When you communicate with SharkTalk by email, telephone, SMS, MMS, in-app chat, or another channel, we may collect:
- The content of the communication;
- Your telephone number or email address;
- The date and time of the communication;
- Call duration;
- Message delivery and response information;
- Customer support or inquiry history;
- SMS opt-in and opt-out records;
- Records showing when and how consent was provided (including form submissions, timestamps, and the consent language displayed); and
- Call recordings or transcripts, when permitted by applicable law and after any legally required notice or consent.
3.5 Call Data Processed Through the Platform
When an AI voice agent handles a call, the Platform may generate and store, on behalf of the Business Customer:
- Caller telephone number and caller-ID information;
- Audio recordings of the call, where enabled by the Business Customer and permitted by law;
- Transcripts, summaries, and AI-generated notes;
- Information the caller provides during the conversation (for example, name, address, service needs, appointment preferences);
- Call outcome, disposition, duration, and actions taken (for example, appointment booked, call transferred, CRM record created); and
- Technical metadata such as call identifiers and routing information.
3.6 Billing and Transaction Information
- Billing name and address;
- Plan, subscription, and usage information (for example, minutes and telephone numbers);
- Invoice and payment status;
- Transaction amounts;
- Payment method type and partial payment information, such as the last four digits of a payment card; and
- Records concerning refunds, disputes, or payment issues.
Complete payment-card details are collected and processed by an independent payment processor. SharkTalk does not store full payment-card numbers or card security codes on its own systems.
3.7 Website and Technical Information
- Internet Protocol address;
- Browser type and version;
- Device type and operating system;
- Pages viewed, features used, and interaction information;
- Referring website;
- Date and time of access;
- Approximate location derived from an IP address;
- Cookie or device identifiers;
- Theme, accessibility, and display preferences you select; and
- Performance, error, or diagnostic information.
3.8 Information Obtained From Other Sources
We may receive information from business partners, referral sources, agencies that manage your account on the Platform, communications and telephony providers, customer relationship management systems, analytics providers, social media platforms, payment processors, publicly available business sources, and other service providers operating on our behalf. We may combine this information with information you provide directly to us.
4. How We Use Personal Information
SharkTalk may use personal information to:
- Create, administer, and secure your account;
- Provide, operate, maintain, and improve the Platform and our services;
- Configure, train, and operate AI voice agents according to your instructions;
- Route, answer, transfer, record, and transcribe calls as configured by Business Customers;
- Connect the Platform to third-party systems you authorize;
- Respond to inquiries and communicate with prospective and current customers;
- Schedule and conduct calls, demonstrations, and consultations;
- Prepare proposals, estimates, contracts, or statements of work;
- Provide customer support;
- Send appointment confirmations, reminders, and service-related updates;
- Process invoices, subscriptions, and payments;
- Maintain business, tax, accounting, and transaction records;
- Generate usage analytics, dashboards, and reports for Business Customers;
- Monitor Platform performance, reliability, and security;
- Detect and prevent fraud, abuse, spam, and unauthorized activity;
- Enforce our agreements and policies;
- Comply with legal, regulatory, tax, telecommunications, and reporting obligations;
- Establish, exercise, or defend legal claims;
- Send marketing communications when permitted by law and after obtaining any legally required consent; and
- Carry out another purpose disclosed to you when information is collected.
We will not use your information for a materially unrelated purpose without providing appropriate notice or obtaining consent when required by law.
5. AI Voice Agents, Call Recording, and Disclosure
5.1 AI Disclosure
AI voice agents deployed through the Platform are automated systems. Business Customers control whether and how an agent identifies itself as an AI assistant. SharkTalk's agents are designed to answer truthfully if a caller asks whether they are speaking with an AI.
5.2 Call Recording and Consent
Call recording and transcription are features that Business Customers may enable. Business Customers are solely responsible for complying with all applicable call-recording, wiretap, telemarketing, and consent laws in their jurisdiction and in the jurisdictions of their callers, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, and state "two-party" or "all-party" consent laws, and for providing any legally required recording notice to callers.
5.3 Use of Call Data to Improve the Service
SharkTalk may use aggregated or de-identified information derived from Platform usage to improve accuracy, reliability, and performance. We do not use Business Customer call recordings or End Caller personal information to train generalized AI models available to other customers without the Business Customer's agreement.
5.4 Human Review
Authorized SharkTalk personnel may access call data when necessary to provide support, investigate errors or abuse, ensure security, or comply with law. Access is limited to personnel with a legitimate need and is logged.
6. SMS and Mobile Messaging Privacy
6.1 How Users May Opt In
SharkTalk sends SMS or MMS messages from its own business telephone numbers only when a recipient has provided appropriate consent or when messages are otherwise permitted by applicable law.
A person may provide consent through one or more of the following methods:
- Selecting the optional, unchecked SMS consent checkbox on the SharkTalk website contact or call-back form;
- Providing express verbal consent during a telephone call with an authorized SharkTalk representative;
- Opting in to SMS notifications within the Platform account settings;
- Sending a text message to a SharkTalk telephone number and requesting a response or further communication; or
- Another documented method clearly identifying SharkTalk as the sender and explaining the types of messages the person agrees to receive.
Consent to receive text messages is voluntary and is not a condition of purchasing goods or services.
On our website forms, the SMS consent checkbox is separate from the acceptance of general terms and is never selected by default.
6.2 Types of Messages
Depending on the consent provided and the nature of the relationship, messages from SharkTalk may include:
- Responses to inquiries;
- Demo and consultation scheduling;
- Appointment confirmations and reminders;
- Onboarding and setup assistance;
- Account, billing, and service-related updates;
- Security alerts and verification codes;
- Customer-support communications;
- Requested information; and
- Other communications described when consent is obtained.
SharkTalk will not use a customer-care messaging program to send unrelated unsolicited advertising.
6.3 Message Frequency and Charges
Message frequency varies depending on the recipient's inquiry, requests, appointments, account activity, and interactions with SharkTalk. Message and data rates may apply according to the recipient's mobile service plan.
6.4 Opting Out
Recipients may opt out at any time by replying STOP to a SharkTalk text message. After receiving a STOP request, SharkTalk may send one final confirmation message stating that the recipient has been unsubscribed. No further messages will be sent through the applicable messaging program unless the recipient provides new consent.

6.5 Mobile Information Non-Sharing Statement
NO MOBILE INFORMATION WILL BE SHARED WITH THIRD PARTIES OR AFFILIATES FOR MARKETING OR PROMOTIONAL PURPOSES.
TEXT MESSAGING ORIGINATOR OPT-IN DATA AND CONSENT WILL NOT BE SHARED, SOLD, RENTED, OR TRANSFERRED TO THIRD PARTIES, AFFILIATES, LEAD GENERATORS, OR DATA BROKERS FOR THEIR OWN MARKETING OR PROMOTIONAL PURPOSES.
SharkTalk may disclose mobile information to service providers that process messages solely on our behalf, including telecommunications, messaging, hosting, customer relationship management, and technology providers. Such providers may access information only as necessary to perform contracted services and are not authorized to use mobile opt-in information for their own marketing.
SharkTalk does not sell mobile telephone numbers or SMS consent records.
6.6 Messages Sent by Business Customers Through the Platform
Business Customers may use the Platform to send SMS messages (for example, appointment confirmations) to their own End Callers. Those messages are sent on behalf of, and under the responsibility of, the Business Customer, which must obtain all legally required consent. Recipients of such messages should contact the business that sent the message, and may reply STOP to opt out.
7. How We May Disclose Personal Information
7.1 Service Providers
We may disclose information to vendors that perform services on behalf of SharkTalk, including:
- Cloud hosting and storage;
- Telecommunications, telephony, and messaging carriers;
- Speech recognition, text-to-speech, and large-language-model providers;
- Email hosting and delivery;
- Customer relationship management and support tools;
- Scheduling;
- Payment processing;
- Accounting and bookkeeping;
- Cybersecurity and monitoring;
- Data analytics;
- Technical support; and
- Legal or professional services.
These providers may process information only as reasonably necessary to provide services to SharkTalk and subject to applicable contractual, confidentiality, or legal obligations. The use of service providers does not permit mobile opt-in data or SMS consent to be used for independent marketing.
7.2 Business Customers and Agencies
Call data generated by an AI voice agent is disclosed to the Business Customer that deployed the agent. If your account is managed by an agency or partner, that agency may access account and call information for the businesses it manages.
7.3 Third-Party Integrations You Authorize
When you connect a third-party system (for example, a CRM, calendar, or telephony provider), we transmit information to that system as you direct. The third party's privacy policy governs its use of that information.
7.4 Legal and Safety Requirements
We may disclose information when we reasonably believe disclosure is necessary to comply with applicable law; respond to a subpoena, court order, or lawful governmental request; protect the rights, property, or safety of SharkTalk, its customers, or others; investigate fraud, abuse, security incidents, or unlawful activity; enforce an agreement or policy; or establish, exercise, or defend a legal claim.
7.5 Business Transactions
Information may be reviewed or transferred in connection with a merger, acquisition, reorganization, financing, bankruptcy, sale of assets, or similar transaction. Mobile opt-in information and SMS consent will not be transferred for the recipient's independent marketing or promotional use.
7.6 At Your Direction
We may disclose information when you request, authorize, direct, or consent to the disclosure.
8. Sale or Sharing of Personal Information
SharkTalk does not sell personal information for monetary compensation.
SharkTalk does not sell or share mobile telephone numbers, mobile information, text-message opt-in records, or SMS consent with third parties or affiliates for marketing or promotional purposes.
Certain privacy laws define "sale" or "sharing" broadly and may include some targeted-advertising or analytics activity even where no money is exchanged. Where such laws apply, eligible individuals may have the right to opt out. Privacy requests may be submitted to info@sharktalk.ai.
9. Cookies and Similar Technologies
Our website and Platform may use cookies, pixels, local storage, scripts, and similar technologies to enable basic functions, keep you signed in, remember preferences (such as theme and accessibility settings), maintain security, understand traffic and usage, identify technical problems, measure performance, and improve the service.
You may adjust your browser settings to block or delete cookies. Blocking certain cookies may affect website or Platform functionality. Where required by applicable law, we will request consent before using non-essential cookies.
10. Analytics and Third-Party Technologies
We may use website analytics or similar technologies to understand how visitors use our website and Platform. Such providers may collect device, browser, cookie, and interaction information under their own privacy policies. We do not authorize analytics or advertising providers to use mobile opt-in data or SMS consent for their own marketing or promotional purposes.
11. Data Retention
We retain information for as long as reasonably necessary to provide services, maintain customer and business records, fulfill the purposes described in this Privacy Policy, comply with tax, accounting, legal, regulatory, telecommunications, and contractual obligations, resolve disputes, enforce agreements, and protect against fraud, abuse, and security incidents.
Call recordings, transcripts, and related call data are retained according to the settings selected by the Business Customer and our agreement with that Business Customer, and are deleted or returned upon termination of the account in accordance with that agreement. When information is no longer reasonably required, we may delete, anonymize, aggregate, or securely dispose of it.
12. Data Security
SharkTalk uses reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, use, alteration, loss, or disclosure. Safeguards include encryption of data in transit and at rest, role-based access controls enforced on the server side, authentication requirements, restricted access to production systems, vetted third-party service providers, monitoring, logging, backups, and procedures for responding to security incidents.
No method of electronic transmission or storage is completely secure. We cannot guarantee absolute security.
13. Privacy Rights
Depending on your state or country of residence and subject to applicable law, you may have the right to request access to personal information; request correction of inaccurate information; request deletion of certain information; request a portable copy of certain information; withdraw consent; object to or restrict certain processing; opt out of certain sales, sharing, or targeted advertising; and appeal the denial of a privacy request.
These rights may be subject to exceptions and verification requirements. To submit a privacy request, email info@sharktalk.ai with the subject line "Privacy Request." We may request information reasonably necessary to verify your identity. We will not unlawfully discriminate against an individual for exercising an applicable privacy right.
If your request relates to a call handled by an AI voice agent on behalf of a Business Customer, we may refer your request to that Business Customer or assist it in responding.
14. California and Other U.S. State Privacy Rights
Residents of California and certain other U.S. states may have additional rights under applicable privacy laws, including rights concerning access, correction, deletion, portability, or opting out of certain sales, sharing, targeted advertising, or profiling.
SharkTalk does not sell mobile information or share SMS opt-in consent with third parties or affiliates for marketing or promotional purposes. Requests may be submitted to info@sharktalk.ai.
15. Children's Privacy
Our website and services are intended for adults and authorized business representatives. We do not knowingly collect personal information directly from children under 13. If you believe a child has submitted personal information to us, contact info@sharktalk.ai so that we may review the matter and take appropriate action.
16. Third-Party Links
Our website may contain links to third-party websites or services. SharkTalk does not control and is not responsible for the privacy, security, content, or practices of third parties. You should review the privacy policies of any third-party service before providing information to it.
17. International Visitors
SharkTalk is based in the United States. If you access our website or services from outside the United States, your information may be transferred to, stored in, or processed in the United States or another country where our service providers operate.
